FyreChat Network, Servers and Services

The FyreChat Network is an Internet Relay Chat established to promoted interaction and communication between individuals, families, friends, and other groups from all over the world. As such, for the protection of FyreChat, its administrators, staff, hardware, and users, the following guidelines have been established to ensure a safe and enjoyable experience for everyone.

By connecting to the FyreChat network, Users are assumed to have read, understood, and agreed to the terms and conditions of the AUP. The AUP is subject to change without notice, and any changes/updates will be immediately considered in full effect. This version supercedes any previous version of the AUP.

The FyreChat Network does not control and/or monitor the content transmitted to or from users. Consequently, FyreChat does not guarantee or assume liability for the accuracy, integrity, or quality of any content. Users understand they may be exposed to material deemed offensive, indecent, or objectionable. FyreChat claims no responsibility or any liability for content, including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available via FyreChat.

By using FyreChat, Users agree to agree to indemnify and hold harmless FyreChat, its resource providers, owners, operators, administrators, and other agents from any and all claims, costs, expenses, judgments, causes of action, attorney fees, litigation and court costs, resulting from use of FyreChat services in any manner, whether directly or indirectly or by any act or omission.

Users are solely responsible for the knowledge of and adherence to any and all laws, statutes, rules and regulations pertaining to (1) the use of any FyreChat service, (2) the communications means by which they connect their terminal, personal computer or other device to FyreChat services or to any
service provided to and by FyreChat, and (3) the FyreChat server they connect to as stated or referenced to in its Message of the Day (/motd).

User rights herein granted cannot be transferred, assigned, shared, sold, or used by anyone other than yourself.

FyreChat Staff

Staff members are defined as IRC Operators, Help Operators, Administrators, and Owners of the FyreChat network and it's servers. These users have been selected to assist with the operations of FyreChat, and as such are granted the ability and authority to make certain decisions regarding appropriate uses and behaviors on the FyreChat server. Users are expected to cooperate and abide by all requests, directives, or inquiries made by FyreChat Staff. Failure to do so could result in the loss of priviledges, upto and including being banned from the FyreChat server.

Members who feel they have been treated unfairly by FyreChat Staff may email admin@fyrechat.net with their grievance.

Prohibited Activites/Uses

FyreChat resolves to be very open minded and fair in what is permitted on its server. However, for the safety and protection of itself and users, the following are a selection of activites, uses, or purposes expressively prohibited from the FyreChat server (this is not all inclusive):

- File Sharing Channels, Bots, or Scripts of Any kind
- Excessive Cloning
- Spam
- Abusive, malicious, or otherwise damaging scripts/bots/etc.
- Abuse of network and/or server resources or services
- Impersonation of Staff members
- Any activities deemed illegal by applicable local, state, and federal laws
- Any activities deemed illegal/unacceptable by the governing policies of the FyreChat host provider
- Any activities deemed illegal/unacceptable by the governing policies of the user's host provider
- Any activities which endanger the physical, mental, or emotional wellbeing of any other user, whether directly or indirectly
- Any other activity or use deemed to be inconducive to FyreChat Network policies, practices, or purposes.

Users in violation of this will be subject to removal and possible banning from the FyreChat Network, as well as a complaint filed with their ISP provider and law enforcement officials where applicable.

Open Proxy Scanning

For security reasons, use of an Open Proxy to connect to the network is prohibited. To enforce this, FyreChat uses the Blitzed Open Proxy Monitor to monitor all connections to the network. Upon connecting to any FyreChat servers, your client will be scanned by the proxy monitor to ensure you are not connecting through an open proxy. By connecting to the network, you agree and give unrestricted permission and consent for the network to use the proxy monitor to scan your connection for such purposes. All scans and results are logged. The FyreChat network will never release the information from the scan logs except in cooperation with requests from law enforcement agencies or ISP providers with legitimate cause for request.
